Seek legal help to file for disability insurance |
By Jack Reed on August 23, 2010
Lying on your bed with a severe back pain, you sadly recall the last day that you attended your office. Now you just keep on thinking about what you can do to prevent your disability insurance from being denied.
Indeed, injuries resulting from your employment can cause disabilities which might prevent you from resuming work. The thought that you have a family to support and huge bills to clear gives you sleepless nights. You have two options in your hand; either you keep worrying about how you will cope with the situation or take pro-active steps in the right direction which can stabilize your financial condition.
Filing a disability case is perhaps the perfect choice for you. As the process is very long and complicated, it is unwise to delay your disability insurance filing. But winning a disability case is often quite difficult. Applications are denied in most of the cases, because people representing themselves in such cases typically make lots of mistakes.
So what should you do? Well, there are various ways to increase your chances of winning a disability case.
In the first thing, you should hire a competent disability paralegal whenever you file for a disability case. A disability paralegal, experienced at handling such cases, is the best person to guide you through the tedious and elaborate process of filing a disability case.
Proving your eligibility for disability insurance often requires the medical staffs to be convinced. Just submitting the application form does not help much. When this application reaches the examiner, he requests the claimant for medical forms. It often leads to fruitless results if the claimer tries to do it all by himself.
Here again, the role of a disability paralegal becomes very important. Being familiar with the process of communicating with medical staffs, a disability professional can procure the medical records easily. He can work closely with the physician to obtain statements that would help to influence disability examiners favorably. If the report just identifies an injury or an illness, then it might not be enough for the claimant to win the case. Therefore, it is necessary for the physician to specify that for how long the claimant would be unable to resume normal work. A competent disability paralegal is adept at managing all these. Once the medical reports are obtained, the paralegal can submit them along with your disability insurance application form to corroborate your claim and thus speed up the filing process effectively.
The filing process is strict and there might still be denial of benefits even after your application has been submitted correctly. If you are confronted with such denial of benefits, you can even hire a disability lawyer to fight your case. Disability cases represented by professional advocates add more credence to disability cases. In most cases it has been found that successfully won disability cases were represented by professionals.
So, if you feel you badly need your disability insurance, then simply brooding and sighing will not help. Gear yourself up, claim your rights and do not allow yourself to become a victim of disability.
