Once individuals fall into debt, they will inevitably have to deal with debt collectors. For some this is not an easy task. There are a few ways that individuals can get help with debt collectors so that this process will be much less problematic.
First, the
Fair Debt Collection Practices Act (FDCPA) protects individuals from harassment and abusive collection practices for many common debts. Some of the few debts that are not protected by this act are debts with the Federal government (such as, between a student and the IRS, etc.), and debts created from running one’s own business. Household debts,
credit card debts,
medical bills, and the many other everyday debts that many Americans struggle with are covered and protected under this act. Individuals who are behind on debts should read up on their rights under this act and the Federal Trade Commission. By reading this information, they will better understand what the collector can and cannot do. Education is the biggest help when it comes to dealing with debt collectors.
Another important point when looking for help with debt collectors is to keep records about everything that happens. The moment an individual is contacted by a debt collection agency they should keep a file with notes on the calls, times of the phone calls, what was discussed during those phone calls, when payments were made, and any other important information about these calls. This information will come in handy not just in case the collection agency decides to sue but also in negotiating with the agency themselves. The more an individual knows about the situation and the more organized they seem, the less likely a collection agency will attempt to take advantage of them. Getting everything in writing will help when it comes to debt collectors as well because these writings will serve as proof of any agreements made with debt collection agencies.
Finally, the best way to get help with debt collectors is to stop giving them a reason to call. Individuals should find a way, either through their own personal organization and management, or by finding help through professional debt management agencies. Sorting through bills, finances, and creating a plan for paying and for finances in the future will help keep individuals from returning to a debt collection situation again.
Although debt collectors can be hard to deal with, it is important to take everything they say and write it down. Informed individuals can thwart off accruing even more debt through fees and mistakes if they keep up with all of their financial stuff. Also, by learning to keep up with their finances, individuals will take the first step in learning to manage their money more efficiently leading to a debt free life.
